General Terms and Conditions

(1) The following General Terms and Conditions (GTC) apply to all deliveries and services in the version valid at the time of the order. Any conflicting or deviating terms and conditions shall not apply; in case of doubt, the statutory provisions shall apply.

(2) A “consumer” within the meaning of these GTC is any natural person who enters into a legal transaction for a purpose that can be attributed neither to their commercial nor to their self-employed professional activity.

1. Conclusion of the Purchase Contract, Retention of Title

The presentation of products in the ea.St online shop does not constitute a legally binding offer, but rather a non-binding product overview.

By clicking the “Place order with obligation to pay” button, you submit a binding offer to conclude a purchase contract. You can review and change the data you have entered and the contents of your shopping cart at any time before submitting the order.

After submitting your order, you will first receive an automated confirmation of receipt by email. This does not yet constitute acceptance of your offer.

The contract is only concluded upon receipt of our express order confirmation by email or upon dispatch of the goods. Until that time, we reserve the right to review the order and to correct any pricing errors.

The goods remain our property until payment has been made in full.

2. Delivery and Shipping Costs

We deliver to the member states of the European Union, Switzerland and the United States. Shipping is carried out by DHL.

Shipping costs within Germany are €5.90 for orders with an order value below €30. Orders with an order value of €30 or more are shipped free of charge within Germany. All amounts stated include VAT.

International shipping costs are €16.99 for orders with an order value below €50. Orders with an order value of €50 or more are shipped free of charge internationally. All amounts stated include VAT where applicable.

The delivery time stated for the respective item applies.

For partial deliveries, shipping costs are charged only once.

For deliveries to Switzerland, the United States or other destinations outside the European Union, import charges, in particular customs duties, taxes and other fees, may apply. These costs are borne by you as the buyer.

3. Payment Methods

The payment methods displayed during the checkout process are available to you. We currently offer the following payment methods:

There is no entitlement to a discount for early payment.

4. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

6. Statutory Liability for Defects

Our goods are subject to the statutory liability for defects (warranty) for a period of at least two years.

If delivered goods are defective, please contact support@ea-st.com.

We will send you a free return shipping label; we will bear the costs of returning defective goods.

7. Disclaimer for External Links

We assume no liability or responsibility for the content of any external websites linked from our pages. ea.St Retail GmbH expressly states that it has no influence over the design or content of third-party websites linked from our website and distances itself from such content. This applies to all links listed on www.ea-st.com.

8. Image Rights

All images used on our website are the property of ea.St Retail GmbH. Any use without our express consent is prohibited. In the event of unauthorized use, we reserve the right to take legal action.

9. Applicable Law, Place of Jurisdiction

The law of the Federal Republic of Germany applies to all legal transactions and relationships with us. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and other international conventions shall not apply.

For consumer contracts, this choice of law applies only to the extent permitted by mandatory European consumer protection provisions.

In business transactions with merchants and legal entities under public law, the place of jurisdiction shall be the registered office of ea.St Retail GmbH (Mühldorf Local Court / Traunstein Regional Court).

10. Severability Clause

If individual provisions of this agreement are or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid or missing provision shall be replaced by the applicable statutory provision.

11. Promotional Terms and Free Gifts

The following applies in the context of special promotional campaigns (e.g. “with a purchase value of €250 or more, you receive a Leisure pair of riding leggings worth €79 free of charge”):

If, following a withdrawal or partial returns, the minimum order value relevant to the promotion is no longer met, the free gift received must be returned in full and unused. If the free gift is not returned or is not returned properly, we reserve the right to deduct its value from the refund amount or to charge it subsequently. This provision applies in addition to the general withdrawal provisions and will be clearly communicated as part of each promotion.

For each REGGINGS® R1 purchased, you will receive one Glücksmoment ticket.*
Not every ticket contains a prize.**
Cannot be combined with other discount codes or promotions.
Cash payment or transfer of prizes is excluded.
The proof of purchase must be retained until the promotion has been fully completed.
eaSt reserves the right to exclude participants from the promotion in cases of misuse or manipulation.
Legal recourse is excluded.

12. Pricing Errors

If incorrect prices are accidentally displayed on our product pages or during the checkout process, for example due to errors or technical malfunctions, we reserve the right to cancel the affected order.

You are not entitled to delivery of the goods at the incorrectly displayed price. Any payments already made will be refunded without undue delay.
